Obama's Gangster Government Operates Above the Law By Michael Barone

Presidents' State of the Union addresses are delivered in the chamber of the House of Representatives in the Capitol. The classical majesty of this building where laws are made symbolizes the idea that we live under the rule of law.

Unfortunately, the 44th president is running an administration that too often seems to ignore the rule of law.

"We can't wait," Barack Obama took to saying after the Republicans captured a majority in the House and refused to pass laws he wanted. He would act to get what he wanted regardless of law.

One example: his recess appointments in January 2012 of three members of the National Labor Relations Board and the head of the Consumer Financial Protection Bureau.

A Real State of the Union By John Stossel

We've heard another State of the Union speech, and my president said grand things like:

"Think about ... a future where we're in control of our own energy ... I will not cede the wind or solar or battery industry to China ... I will not back down from protecting our kids from mercury poisoning ..."

Actually, he said that in 2012. I write before this year's speech, but he says basically the same thing every year: With more spending, government can fix everything.

There were two extraordinary disclosures in Thursday's testimony of Defense Secretary Leon Panetta and Joint Chiefs Chairman Martin Dempsey before the Senate Armed Services Committee.

One is that there was no communication between them and Barack Obama or Secretary of State Hillary Clinton in the seven hours of Sept. 11, 2012, when Ambassador to Libya Christopher Stevens and three other Americans were attacked and murdered in Benghazi.

After 20 Years, Success of Family and Medical Leave Act Should Humble the Far Right By Joe Conason

When Bill Clinton signed the Family and Medical Leave Act on Feb. 5, 1993 almost exactly 20 years ago as the first legislative act of his presidency, its establishment as law marked a progressive victory after nearly a decade of ferocious opposition by corporate lobbyists, Republican legislators, conservative media and right-wing pundits.

Leading the opposition was the U.S. Chamber of Commerce, whose spokeswoman Virginia Lamp denounced the act as "a dangerous precedent." (She would eventually marry Supreme Court Justice Clarence Thomas and move on to employment with the Koch brothers.) With the honorable exception of the Catholic Church and a number of moderate Republicans in Congress, the self-proclaimed "pro-family" forces in American political life eagerly aided and abetted the Chamber's attempt to kill the act. Mandating a federal right to unpaid leave, even if restricted to certain workers in larger businesses, would place the nation on a slippery path toward European socialism, or worse, according to the Chamber and its Republican allies and impose untold damage on business.

Ban This! Ban That! Ban This and That! By John Stossel

I like to bet on sports. Having a stake in the game, even if it's just five bucks, makes it more exciting. I also like playing poker. "Unacceptable!" say politicians in much of America. "Gambling sometimes leads to 'addiction,' destitute families!"

Well, it can.

So politicians ban it. It's why we no longer see a poker game in the back of bars. Half the states even ban poker between friends -- though they rarely enforce that.

America's alleged "baby bust" is pushing the country over "a demographic cliff." So argues Jonathan V. Last in The Wall Street Journal. Stacking one highly debatable claim on the next, Last builds a palace of hooey, in the basement of which sits a conservative agenda that's not very conservative.

Here are the agreed-on facts: America's fertility rate -- the number of children born by the average woman -- has dipped below the replacement level of 2.1 children per woman. Were it not for immigrants' having more children, it would be lower still. All arrows point to it going down further, as the Latino fertility rate plummets. (In Mexico, it's at the replacement level.)

Fewer Dollars and Babies Threaten Social Programs By Michael Barone

Our major public policies are based on the assumption that America will continue to enjoy growth. Economic growth and population growth.

Through most of our history, this assumption has proved to be correct. These days, not so much.

Last week, the Commerce Department announced that the gross domestic product shrunk by 0.1 percent in the fourth quarter of 2012. And the Census Bureau reported that the U.S. birth rate in 2011 was 63.2 per 1,000 women age 15 to 44, the lowest ever recorded.

Benghazi Hearings: Capitol Hill's Angry Little Men Keep Making Hillary Bigger By Joe Conason

Anyone truly concerned about the safety of U.S. diplomatic personnel abroad -- and that should include every American -- has fresh reason for fury over last September's disaster in Benghazi and its aftermath. But the target of public anger should not be Secretary of State Hillary Clinton, whose conduct has been exemplary ever since the U.S. ambassador to Libya and three of his brave colleagues lost their lives last September. Far more deserving of scorn are the likes of Republican Senators Rand Paul of Kentucky and Ron Johnson of Wisconsin and all the other grandstanding, conspiracy-mongering, ill-informed politicians who questioned her Wednesday on Capitol Hill.

Four months after the tragedy occurred, Republicans on both the Senate Foreign Relations Committee and the House Foreign Affairs Committee still seem to be obsessed with the talking points provided to U.N. Ambassador Susan Rice before she appeared on television to discuss the incident.

Watching President Obama's inaugural, I was confused. It looked like a new king was being crowned. Thousands cheered, like subjects worshipping nobility. At a time when America faces unsustainable debt and terrible economic troubles, why such pomp?

So much for the "Grand Bargain" -- or at least for the not-so-grand gutting of Social Security and Medicare that the "very serious" thought-leaders of Washington political and media circles have always found so appealing. Whatever President Obama may have contemplated up until now, his second inaugural address, delivered yesterday on the steps of the Capitol, bluntly repudiated Republican arguments against the social safety net -- and forcefully identified those popular programs with the most sacred American values.

"We, the people, still believe that every citizen deserves a basic measure of security and dignity," said Obama -- not only because it is the responsibility we have to each other as human beings, but because security and dignity, for every man, woman, and child, are the existential foundations of freedom.
